Terms of Service
The terms that govern your use of EyeOut, the real-time AI brand monitoring and social listening platform that tracks every mention, reads sentiment and alerts you to spikes. Last updated: June 2026.
Acceptance of these terms
By using eyeout.com or signing up for EyeOut, you agree to these terms of service. If you are acting on behalf of an organization, you agree on its behalf and confirm you are authorized to do so. If you do not agree, do not use the service. Larger accounts may also be governed by a specific agreement established with the customer, which prevails over these terms where they differ.
What EyeOut is
EyeOut is a real-time AI brand monitoring and social listening platform. It tracks mentions of the brands, products, competitors and keywords you choose across web, news, X, Reddit, Instagram, forums, podcasts and review sites, reads sentiment, emotion and themes with AI, measures share of voice, and fires spike and crisis alerts with a suggested first move. It is a self-serve product on paid monthly plans, with seats for your team and alerts to Slack, email and webhooks.
The service surfaces and analyzes publicly available mentions. You remain responsible for the keywords and sources you choose to monitor, for ensuring you are entitled to monitor them, and for how you act on what EyeOut shows you. You can review and control your keywords, channels, alert thresholds and team access.
Your responsibilities
You are responsible for using the service in line with all laws that apply to you, including data protection and privacy laws such as the GDPR, and the terms of service of any source or platform you ask EyeOut to monitor. You agree to only monitor brands, keywords and public sources you are entitled to track, to use the insights lawfully, and not to use EyeOut to harass, profile unlawfully, or otherwise harm any individual. You agree to provide accurate information and to use the service responsibly.
Acceptable use
EyeOut is intended for legitimate brand monitoring, social listening, PR and competitive research by organizations tracking publicly available conversations. You agree to use the service responsibly and to comply with all applicable laws, professional standards and codes of conduct.
You agree not to use the service to:
- Monitor, profile or target individuals in ways that break privacy, data protection or anti-harassment laws.
- Attempt to access private, gated or restricted content, or circumvent the access limits of any source.
- Resell, redistribute or scrape the data EyeOut produces for resale, except under a written agreement with us.
- Submit or track data you do not have the right to use, or that infringes someone else's rights.
- Attempt to disrupt, reverse engineer, scrape, or overload the service or circumvent its limits.
- Resell or redistribute the service except under a written agreement with us.
You are responsible for the keywords and sources you configure and how you use the output.
Your content and data
As between you and us, you keep all rights to the configuration you submit and to the reports and insights you receive. You grant us only the limited permission needed to provide the service to you, including processing publicly available mentions that match your keywords. As described in our privacy policy, EyeOut processes publicly available content plus your account data, is GDPR-ready, and never sells your data.
Accounts and access
You must provide accurate information when you sign up and keep any credentials secure. You are responsible for activity that happens under your account and the seats you invite. Tell us promptly if you believe your account or access has been used without your permission.
Plans, billing and refunds
EyeOut is offered on paid plans only, with no free plan, billed self-serve as a monthly subscription that starts at $59 per month. Higher mention volumes and additional seats move up the plans. All prices and charges are in US dollars. Subscriptions renew automatically, monthly or yearly depending on the term you choose, until you cancel, and you can cancel anytime. Except where required by law or stated in your agreement, payments are non-refundable. The specific commercial terms for your organization, where applicable, are set out in your order or agreement, which controls where it differs from this section.
Service availability
We work to keep EyeOut available and performing well, but we do not guarantee uninterrupted access, and the timeliness and completeness of mentions depends on the public sources and third parties we rely on. We may update, change or temporarily suspend features to maintain and improve the service. Service levels for larger accounts, where applicable, are set out in your agreement.
Intellectual property
EyeOut, including its software, models, interface, content and brand, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these terms and your agreement. You may not copy, modify, distribute or create derivative works from the service except as expressly permitted. The names of other companies and products referenced on this site are used for identification only and remain the property of their respective owners.
Disclaimers
To the fullest extent permitted by law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service is error-free, that every mention is captured, or that sentiment scoring is perfectly accurate. We do not provide legal advice, and you remain responsible for your own legal compliance. The figures shown on this site are typical outcomes, not guarantees.
Limitation of liability
To the maximum extent permitted by law, EyeOut and its team will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law. Our total liability for any claim will not exceed the amount you paid us for the service in the twelve months before the claim, unless your agreement provides otherwise.
Termination
You can stop using the service and cancel at any time. We may suspend or terminate access if you breach these terms or use the service in a way that risks harm to others or the platform.
Changes to these terms
We may update these terms as the service evolves. When we make material changes we will update the date above and, where appropriate, notify you. Continued use after changes means you accept the updated terms.
Governing law
These terms are governed by the laws of [governing jurisdiction], without regard to its conflict-of-laws rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, except where your customer agreement specifies otherwise.
